A word from the Samson Rising Legal Team

We have been retained by the creators of the Samson Rising website, to provide advice on the content of the site and to inform its users.

The role we play is dependent on how many people complete the online survey, which will then determine how we can assist those people. The more survey results collected by Samson Rising, the clearer the picture we’ll have of the truth and the assistance that may be offered.

This anonymous survey will allow us to determine if laws have been broken, and to let you know what options there are to prevent future breaches. We can also tell you if compensation is available to those that may have suffered harm, loss or damage.

We understand that taking legal action is not for everyone.  Some people are only seeking an apology. Some just want any malicious conduct to stop.  Others may wish to receive information about how to gain financial compensation.

Samson rising has retained us to help with all of these possible outcomes.

We are a prominent legal practice, which has successfully brought class actions at the highest level in Australia. You would know some of these cases, because of the media coverage they received and the number of people we were able to help.

Samson Rising has asked that we not identify our firm at this time. This is so users of the site do not approach us directly or in an uncoordinated way.

Once we’ve analysed the survey results, and provided advice to Samson Rising, you will have the option to receive information about your legal options.  Whether you choose to take things further is entirely your choice and is obligation free.

Before we go, Samson Rising has asked us to provide a brief description of how a class action works.

When a group of people, in a similar situation, choose to commence legal action against another party who has caused, the common harm, damage or loss, it is referred to as a class action. These people are called the members of the class and a representative member acts as the lead plaintiff on behalf of all the members of the class.

To reduce the costs, the members of the class all contribute to the costs of running the matter, and a common agreement is signed with each member of the class, and the legal firm running the class action.

The agreement sets out the rules for how you can be part of the class action, and how you can leave the class action if you change your mind.

One of our firm’s most recent class actions, was also funded by what’s called a ‘litigation funder’. The litigation funder pays for almost all the cost, and they wear the risk if the class action fails.

This meant plaintiffs in our firm’s most recent class action, were only required to pay $150/month to be part of the class action. This was on a ‘come and go basis’. So, plaintiffs could leave the class action along the way without additional cost if they wanted to.

Sometimes legal action becomes unnecessary, because the other side negotiates an acceptable outcome. If this is a possibility, we’ll be there to help the Samson Rising team.
